Terms of Service
These terms govern your use of vivaritual.com and any purchase made through it. By using the site you accept these terms. If you do not agree, please do not use the site.
1. Products and representations
VivaRitual sells dietary supplements and wellness equipment. Statements about ingredients and expected effects have not been evaluated by Health Canada or the U.S. Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. Consult a licensed healthcare professional before starting any new regimen, especially if you are pregnant, nursing, taking medication, or managing a chronic condition.
We do not publish fake or incentivized reviews without disclosure. Any testimonial visibly marked as a customer testimonial reflects an individual experience and is not a guarantee of results (FTC Guides on Endorsements, 16 CFR § 255).
2. Pricing and currencies
Prices are displayed in Canadian dollars (CAD) for Canadian IPs and United States dollars (USD) for U.S. IPs via Shopify Markets. Applicable taxes and duties are calculated at checkout. We reserve the right to correct obvious pricing errors before shipping.
3. Order acceptance
Your order is an offer to purchase. We accept it upon sending the shipping confirmation. Until then we may refuse or cancel an order for any lawful reason, including suspected fraud, out-of-stock conditions, or obvious pricing mistakes. If we cancel, you receive a full refund.
4. Shipping and risk of loss
Title and risk of loss pass to you once the package is delivered to the carrier. Shipping details, delays, and fees are described on our Shipping page.
5. Returns and refunds
Unopened ingestibles may be returned within 30 days in line with our Returns policy. Opened or partially used ingestibles cannot be returned for safety reasons (CFIA guidance).
6. Limitation of liability
To the maximum extent permitted by applicable law, VivaRitual is not liable for indirect, incidental, or consequential damages. Our total liability in connection with any product is limited to the amount you paid for that product.
Nothing in these terms limits rights you may have under the Québec Consumer Protection Act, Canada's Competition Act, or state-law consumer protections that cannot be waived by contract.
7. Governing law
These terms are governed by the laws of the Province of Québec and the laws of Canada applicable therein, without regard to conflict-of-law principles. For Québec residents, the mandatory provisions of the Consumer Protection Act apply. For residents of other Canadian provinces and the United States, your local mandatory consumer-protection laws continue to apply.
Disputes will be brought before the competent courts of the District of Montréal, unless a mandatory provision of your local law requires otherwise.
